FY 2024 FAIR Act Inventory - Office of the Inspector General

The Federal Activities Inventory Reform Act of 1998 (the FAIR Act) directs federal agencies to prepare each year an inventory of commercial activities performed by federal employees.  Office of Management and Budget (OMB) Circular A-76 establishes federal policy regarding the performance of commercial activities and implements the requirements of the FAIR Act.  Consistent with the OMB’s guidance, the NRC and DNFSB OIG reviewed the activities performed by each of our full-time equivalent (FTE) employees to determine whether the activities are commercial in nature or inherently governmental.  As a result of this review, we have classified 59 FTEs as inherently governmental and 4 FTEs as potentially commercial in nature in FY 2024.

Inventory of Potential Commercial Activities

The FY 2024 Inventory of Commercial Activities, which the OIG compiled according to OMB guidance, reports on the number of employees aligned with activities deemed to be commercial in nature.  The OIG lists information according to the function codes developed by OMB, and “reason codes” are used to provide important information regarding the inventory.

Reason Code Explanation:

"A" - This is a commercial activity, but the Inspector General has determined that, to achieve the OIG’s mission or specific organizational objectives, the activity must be performed in-house.

Consistent with the FAIR Act, our FY 2024 Inventory of Commercial Activities is made available to the public.

Inventory of Inherently Governmental Activities

The NRC and DNFSB OIG FY 2024 Inventory of Inherently Governmental Activities, which the OIG compiled according to OMB guidance, reports on the number of employees performing activities that are inherently governmental.  The OIG provides information regarding these inherently governmental activities according to the function codes developed by OMB.

Inherently governmental activities are work functions that are required to be performed by federal employees and are not subject to the FAIR Act.  The OIG’s 59 inherently governmental FTEs are classified as such because they perform functions that are specifically exempt from the cost-comparison requirements of OMB Circular A-76 and its Supplement.  The FTEs performing these functions include criminal investigators with statutory law enforcement authority (12 FTE), senior managers (5 FTE), team leaders (5 FTE), administrative assistants to the Inspector General and other senior managers (3 FTE), budget execution staff (1 FTE), an information technology project manager (1 FTE), human resources project managers (2 FTE), a senior public affairs specialist (1 FTE), legal staff (2 FTE), senior technical advisors (4 FTE), editor/writers, a quality assurance manager (3 FTE), and auditors whose duties require them to exercise discretion in applying government authority or use their value judgments in making decisions (20 FTE).

Public Notification:

Consistent with the FAIR Act, the NRC and DNFSB OIG FY 2024 Inventory of Inherently Governmental Activities is made available to the public.
